1. INTRODUCTION
Welcome to CineWin. These Terms and Conditions of Use (hereinafter referred to as
"Terms", "Terms of Service", or "Agreement") govern your access to and use of the
CineWin website (accessible at cinewin.in and the CineWin mobile application
(collectively referred to as the "Platform"). The Platform is owned and operated by
Amugi Mediatech Private Limited (hereinafter referred to as "CineWin", "we", "us", or
"our").
By accessing or using our Platform, you agree to be bound by these Terms and our
Privacy Policy. If you disagree with any part of these Terms, you may not access the
Platform.

2. DEFINITIONS
a. "User", "You", or "Your" refers to you, as a user of our Platform.
b. "Services" refers to all services provided by CineWin through the Platform,
including but not limited to quizzes, contests, and educational content related to
cinema.
c. "Content" refers to all text, images, videos, audio, or other material displayed on
or available through the Platform.

3. ELIGIBILITY
a. The Platform is available only to users who are at least 18 years old. By using the
Platform, you represent and warrant that you are at least 18 years of age.
b. If you are accessing the Platform from a jurisdiction that requires parental consent
for minors to enter into online agreements, you represent that you have obtained
such consent.

c. We reserve the right to terminate your account and access to the Platform if we
discover that you are under 18 years of age.

4. ACCOUNT REGISTRATION
a. To access certain features of the Platform, you may be required to register for an
account. You agree to provide accurate, current, and complete information during
the registration process and to update such information to keep it accurate,
current, and complete.
b. You are responsible for safeguarding your password to access the Platform and
for any activities or actions under your password.
c. You agree not to disclose your password to any third party. You must notify us
immediately upon becoming aware of any breach of security or unauthorized use
of your account.

5. SERVICES
a. CineWin provides an online platform for cinema enthusiasts to participate in
quizzes, contests, and educational activities related to global cinema.
b. Our Services include, but are not limited to:
i. Online quizzes and trivia games related to cinema
ii. Interactive challenges and contests
iii. Educational content about film history, genres, directors, and
actors
iv. Rewards and prizes for top performers
c. Contests and Prizes:
i. Certain contests may involve cash prizes, subject to applicable laws and
regulations in India.
ii. All our contests are based on skill and knowledge rather than
chance, in compliance with Indian law.
iii. To be eligible for prizes, participants must correctly answer a
predetermined number of questions.

iv. Cash prizes are subject to applicable taxes and a nominal service
fee.

d. We reserve the right to modify, suspend, or discontinue any part of our Services at
any time without notice or liability.

6. USER CONDUCT
a. By using the Platform, you agree not to:
i. Use the Platform in any way that violates any applicable laws or
regulations
ii. Impersonate any person or entity, or falsely state or misrepresent
your affiliation with a person or entity
iii. Interfere with or disrupt the Platform or servers or networks
connected to the Platform
iv. Attempt to gain unauthorized access to any portion of the Platform
or any other systems or networks connected to the Platform
v. Use the Platform to transmit any viruses, worms, defects, Trojan
horses, or any items of a destructive nature
vi. Use any robot, spider, or other automatic device, process, or means
to access the Platform for any purpose
vii. Use the Platform in any manner that could disable, overburden,
damage, or impair the Platform

7. INTELLECTUAL PROPERTY
a. The Platform and its original content (excluding Content provided by users),
features, and functionality are and will remain the exclusive property of CineWin
and its licensors.
b. The Platform is protected by copyright, trademark, and other laws of India and
foreign countries.
c. Our trademarks and trade dress may not be used in connection with any product
or service without the prior written consent of CineWin.

d. Any content you submit to the Platform, including quiz answers or user-generated
content, may be used by us in accordance with these Terms and our Privacy
Policy, subject to the provisions of the Indian Copyright Act, 1957, and other
applicable intellectual property laws in India.

8. USER CONTENT
a. You retain any and all of your rights to any Content you submit, post, or display
on or through the Platform and you are responsible for protecting those rights.
b. By posting Content on the Platform, you grant us a worldwide, non-exclusive,
royalty-free license (with the right to sublicense) to use, copy, reproduce, process,
adapt, modify, publish, transmit, display and distribute such Content in any and
all media or distribution methods now known or later developed.

9. PRIVACY
a. Your privacy is important to us. Please review our Privacy Policy, which explains
how we collect, use, and disclose information about you.
b. Our Privacy Policy complies with the Information Technology (Reasonable
Security Practices and Procedures and Sensitive Personal Data or Information)
Rules, 2011, under the Information Technology Act, 2000, and the Digital
Personal Data Protection Act (DPDPA), 2023.
c. We collect and process personal data categories including but not limited to name,
email address, contact information, and usage data. The purpose of processing this
data includes providing our services, improving user experience, and complying
with legal obligations. Users have the right to withdraw consent at any time and
can exercise their data rights by contacting us. Complaints can be made to the
Data Protection Board of India.
d. Under the DPDPA, users have the right to access, correct, erase, and port their
data. Users can request access to their data, request corrections for inaccuracies,
request deletion of their data, and request data portability by contacting us.
e. In the event of a data breach, we will notify affected users and the Data Protection
Board of India within the time frame stipulated by the DPDPA. We will provide

details of the breach, the data affected, and the measures taken to mitigate the
impact.
f. We retain personal data for as long as necessary to fulfill the purposes for which it
was collected, including legal, accounting, or reporting requirements. Users can
request deletion of their data, and we will comply unless we are required to retain
it for legal reasons.
g. We adhere to the principles of data processing as outlined in the DPDPA,
including lawfulness, fairness, transparency, purpose limitation, data
minimization, accuracy, storage limitation, integrity, and confidentiality.
h. Personal data may be transferred to and processed in countries outside India. We
ensure that such transfers comply with the DPDPA and that adequate safeguards
are in place to protect your data.
i. We do not knowingly collect personal data from children under the age of 18. If
we become aware that we have collected personal data from a child under 18
without parental consent, we will take steps to delete such information.
j. Users can submit requests to access, correct, erase, or port their data by contacting

stipulated by the DPDPA.
k. We implement appropriate technical and organizational measures to ensure a level
of security appropriate to the risk, including encryption, access controls, and
regular security assessments.

10. COMMUNICATIONS
a. By creating an account on our Platform, you agree to receive communications
from us in electronic form.
b. You may opt-out of certain communications as per the provisions of the
Information Technology Act, 2000, and the Indian Telecom Commercial
Communications Customer Preference Regulations, 2010.

11. THIRD-PARTY LINKS

a. The Platform may contain links to third-party websites or services that are not
owned or controlled by CineWin.
b. CineWin has no control over and assumes no responsibility for, the content,
privacy policies, or practices of any third-party websites or services.

12. TERMINATION
a. We may terminate or suspend your account immediately, without prior notice or
liability, for any reason whatsoever, including without limitation if you breach the
Terms.
b. Upon termination, your right to use the Platform will immediately cease.

13. LIMITATION OF LIABILITY
a. In no event shall CineWin, nor its directors, employees, partners, agents,
suppliers, or affiliates, be liable for any indirect, incidental, special, consequential
or punitive damages, including without limitation, loss of profits, data, use,
goodwill, or other intangible losses, resulting from:
i. Your access to or use of or inability to access or use the Platform
ii. Any conduct or content of any third party on the Platform
iii. Any content obtained from the Platform
iv. Unauthorized access, use or alteration of your transmissions or
content

b. Nothing in these Terms shall limit or exclude our liability for death or personal
injury resulting from our negligence, fraud, or any other liability that cannot be
excluded or limited under applicable Indian law.

14. DISCLAIMER
a. Your use of the Platform is at your sole risk. The Platform is provided on an "AS
IS" and "AS AVAILABLE" basis.
b. CineWin does not warrant that:

i. The Platform will function uninterrupted, secure or available at any
particular time or location
ii. Any errors or defects will be corrected
iii. The Platform is free of viruses or other harmful components
iv. The results of using the Platform will meet your requirements

15. GOVERNING LAW
a. These Terms shall be governed and construed in accordance with the laws of
India.
b. Our failure to enforce any right or provision of these Terms will not be considered
a waiver of those rights.

16. CHANGES TO TERMS
a. We reserve the right, at our sole discretion, to modify or replace these Terms at
any time.
b. By continuing to access or use our Platform after those revisions become
effective, you agree to be bound by the revised Terms.

17. DISPUTE RESOLUTION
a. Any dispute arising out of or in connection with this Agreement shall be referred
to and finally resolved by arbitration under the Arbitration and Conciliation Act,
1996, as amended or re-enacted from time to time.
b. You and CineWin shall mutually appoint a sole arbitrator. All proceedings in any
such arbitration shall be conducted in English and the venue shall be Pune], India.
c. The courts in Pune, India shall have exclusive jurisdiction to deal with the
arbitration proceedings and the awards in accordance with the law.

18. COMPLIANCE WITH INDIAN LAWS
a. Anti-Money Laundering: We comply with the Prevention of Money Laundering
Act, 2002, and related rules and regulations. We may require additional
information or documentation from you to ensure compliance.

b. Consumer Protection: These Terms comply with the Consumer Protection Act,
2019, and related rules and regulations. Nothing in these Terms shall limit your
rights as a consumer under Indian law.
c. Information Technology Laws: We comply with the Information Technology
Act, 2000, and related rules and regulations, including those related to data
protection and cyber security.
d. Taxation: Any prizes or rewards won through our Services may be subject to
applicable taxes, including tax deducted at source, under Indian law. You are
solely responsible for paying any such taxes.
e. Contest Regulations: Our contests and quizzes comply with relevant Indian laws
and regulations governing online skill-based games. We ensure that our contests
are not in the nature of gambling or betting as prohibited under Indian law.
